These Listing Terms and Conditions ("Listing Terms") govern the relationship between [LEGAL_ENTITY_NAME] (ABN [ABN_NUMBER]) ("Migration Registry", "we", "us", "our") and any migration agent or migration business ("you", "your") that claims a profile or purchases a subscription on migrationregistry.com.au (the "Site").

By claiming a profile or purchasing a subscription, you agree to be bound by these Listing Terms, our Terms of Use, and our Privacy Policy.

1. The Directory Service

Migration Registry is an online directory that lists registered migration agents and migration businesses in Australia. We source initial listing data from the publicly available MARA Register maintained by the Office of the Migration Agents Registration Authority (OMARA).

All registered migration agents appear in the directory by default with a free listing based on publicly available MARA data. Claiming a profile and purchasing a subscription provides additional features as described below.

2. Listing Tiers

Free Listing (Default)

Every registered migration agent and their associated business has a profile generated from publicly available MARA Register data. Free listings include:

  • Profile page displaying MARA-sourced data (name, MARN, registration status, business name, location)
  • Inclusion in relevant city, visa type, and language listing pages
  • "MARA Registered" status indicator (reflects verified registration data)

Free listings display an "Unclaimed" indicator. No action or payment is required for a free listing.

Verified Subscription

By purchasing a Verified subscription, you may:

  • Remove the "Unclaimed" indicator from your business and linked agent profiles
  • Add a business description, logo, and custom contact details
  • Display a "Verified" badge on your business and linked agent profiles
  • Edit profile content for your business and linked agents

Featured Subscription

By purchasing a Featured subscription, you receive all Verified benefits plus:

  • Priority placement in listing pages (city, visa type, language listings)
  • "Featured" badge displayed on your business and linked agent profiles
  • Enhanced visual treatment on agent cards and business profile

Featured listings are clearly labelled as "Featured" to site visitors. Priority placement means your linked agents appear in a designated featured section at the top of relevant listing pages. Featured status does not affect ordering within non-featured search results.

3. Pricing and Payment

Pricing

Current subscription pricing is displayed on the pricing page. Prices are in Australian dollars and include GST where applicable.

We offer monthly and annual billing cycles. Annual subscriptions are billed upfront for 12 months at a discounted rate.

Payment processing

All payments are processed by Stripe. By purchasing a subscription, you agree to Stripe's Terms of Service. We do not store your credit card details.

Price changes

We may change subscription pricing with at least 30 days' notice. Price changes apply at the next billing cycle after the notice period. Existing annual subscriptions are honoured at the original price until renewal.

4. Subscriptions, Renewals, and Cancellation

Automatic renewal

Subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless cancelled. You will be charged the then-current subscription price at renewal.

Cancellation

You may cancel your subscription at any time by contacting us. Upon cancellation:

  • Your subscription remains active until the end of the current paid billing period
  • Your listing reverts to the Free tier at the end of the paid period
  • Any content you added (description, logo, photos) will be removed from public display when your listing reverts to Free
  • No partial refunds are provided for unused portions of a billing period

Refunds

Refund requests are assessed on a case-by-case basis. Under the Australian Consumer Law, you are entitled to a refund if:

  • The service was not provided as described
  • The service was substantially unfit for its purpose
  • The service was not delivered with due care and skill

Nothing in these Listing Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

5. Your Obligations

By claiming a profile or purchasing a subscription, you represent and warrant that:

  • You are a registered migration agent with a current MARN, or an authorised representative of a registered migration business
  • All information you provide for your listing is accurate, current, and not misleading
  • You will promptly update your listing information if it changes
  • You will notify us immediately if your MARA registration is cancelled, suspended, or subject to conditions
  • You have the right to use any logos, images, or content you upload to your listing
  • You will comply with all applicable laws, including the Migration Act 1958 (Cth), the Migration Agents Code of Conduct, and the Australian Consumer Law

You are solely responsible for the accuracy of the information displayed on your listing. We do not verify the accuracy of agent-submitted content beyond confirming MARA registration status.

6. Our Rights

We reserve the right to:

  • Remove or suspend any listing at our sole discretion, including where:
    • Your MARA registration is cancelled, suspended, or expired
    • Your listing contains inaccurate, misleading, or inappropriate content
    • We receive a substantiated complaint about your listing or services
    • You breach these Listing Terms
  • Modify listing features and tier inclusions with reasonable notice
  • Update your listing with current information from the MARA Register, which may override agent-submitted information where there is a conflict (e.g., registration status)
  • Display your MARA-sourced information on the Site regardless of subscription status, as this information is publicly available

If we remove or suspend a paid listing due to your breach of these terms, no refund is provided. If we remove or suspend a listing for reasons not attributable to you, we will provide a pro-rata refund for any unused subscription period.

7. No Endorsement

A listing on Migration Registry — including a Verified or Featured listing — does not constitute an endorsement, recommendation, or guarantee by Migration Registry of your services, qualifications, or competence.

We do not assess or guarantee the quality of services provided by any listed agent or business.

8. Content Licence

By uploading content to your listing (including business descriptions, biographies, logos, and images), you grant Migration Registry a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content for the purpose of operating and promoting the directory.

This licence continues for as long as the content is displayed on the Site. Upon removal of content (by you or by us), the licence terminates, except that cached or archived copies may persist for a reasonable period.

You retain ownership of all content you upload. You warrant that you own or have the right to licence all content you upload and that it does not infringe any third party's intellectual property rights.

9. Liability

Your liability to us

You agree to indemnify and hold harmless Migration Registry, its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your breach of these Listing Terms
  • Any content you upload to your listing
  • Your provision of migration services to clients who found you through the Site
  • Any claim that your listing content infringes a third party's intellectual property rights

Our liability to you

To the maximum extent permitted by law, Migration Registry will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your listing or subscription, including loss of revenue, clients, or business opportunities.

Our total liability to you for any claim arising out of or in connection with your subscription will not exceed the total subscription fees paid by you in the 12 months preceding the claim.

10. Complaints and Disputes

If you have a complaint about your listing or subscription, contact us at [CONTACT_EMAIL]. We will acknowledge your complaint within 5 business days and aim to resolve it within 30 days.

11. Term and Termination

These Listing Terms commence when you claim a profile or purchase a subscription and continue until:

  • You cancel your subscription (listing reverts to Free tier at end of paid period)
  • We terminate your listing in accordance with Section 6
  • You request removal of your free listing (subject to our right to display publicly available MARA data)

Sections that by their nature should survive termination will survive, including Sections 7 (No Endorsement), 8 (Content Licence — for the wind-down period), 9 (Liability), and this Section 11.

12. Changes to These Terms

We may update these Listing Terms from time to time. We will notify subscribers of material changes at least 30 days before they take effect, using the email address associated with your subscription. Continued use of a paid listing after changes take effect constitutes acceptance.

13. Governing Law

These Listing Terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

14. Severability

If any provision of these Listing Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
